These Terms and Conditions ("Terms") govern the use of Blue-lens.com ("the Website"), operated by Fly and Dive SLU, located in Andorra. By accessing and using our Website, booking a workshop, enrolling in online tutorials, or using our post-production services, you agree to comply with and be bound by these Terms.

By accessing and using our Website, booking a workshop, enrolling in online tutorials, or using our post-production services, you agree to these Terms.
2. Booking Workshops
2.1 Booking Process:
You must confirm your participation at least 60 days before the start of the workshop. If places are still available, bookings may be made up to 7 days before the workshop begins. However, if you book less than 60 days before the start date, you are required to pay the full amount of the workshop at the time of booking, with no option for a deposit. The minimum number of participants varies by workshop, typically 8, but may be lower. The maximum number of participants is never more than 12.
2.2 Prerequisites:
The required diving level for each workshop depends on the type of workshop. As a general rule, participants must have a minimum certification of Advanced Open Water (PADI, SSI, or other international certification) or Level 2 CMAS. Participants must also have at least 50 logged dives. You must bring your own photographic or video equipment. If you do not have your own, Blue-lens.com can provide rental equipment, but you must notify us when paying the deposit.
2.3 Late Arrival:
If you arrive late, you will lose the days of the workshop and the activities, including diving sessions, that take place during your absence. No refunds will be provided in case of late arrival or illness during the workshop.
2.4 Diving Safety:
Participants are responsible for their own safety while diving, as the required diving level ensures each diver is capable of managing their safety. However, divers will always be accompanied by a member of the Blue-lens team or its dive service provider. Despite this accompaniment, each diver remains fully responsible for their own safety. Insurance is not included in the workshop (as stated on the product pages of the Website).
2.5 Inclusions and Exclusions:
The price includes accommodation, meals, and internal transportation during the workshop. Flights are not included. Dive equipment is not included but can be rented at an additional cost. When available, NITROX is always provided free of charge.
2.6 Use of images and videos captured by Blue Lens:
All photos and videos taken by Blue Lens teams during the workshops are the exclusive property of Blue Lens. These images and videos may be used by Blue Lens for promotional, educational or commercial purposes, including on its digital platforms, social networks, and marketing materials. By accepting these general conditions, participants consent to Blue Lens using these contents without requiring additional authorization. No remuneration or compensation will be due to participants for the use of these contents.
3. Online Tutorials
3.1 Course Access:
Blue-lens.com offers pre-recorded online tutorials that clients can purchase through the Website. These tutorials help participants enhance their underwater photography and videography skills, focusing on post-production techniques such as photo retouching, video editing, and color grading.
3.2 Course Content:
Tutorial content varies by course and may include topics such as underwater camera settings, composition techniques, editing tips, and color grading. Detailed course information is available on the Website.
3.3 Payment and Access:
Full payment is required to enroll in a tutorial. Once payment is received, immediate access to the tutorial content will be granted via the client’s account on the Website. Tutorials are non-refundable once access is granted.
3.4 Intellectual Property:
The tutorial content is protected by intellectual property laws. Clients receive a non-exclusive, non-transferable license to view the tutorials for personal use only. Redistribution, reproduction, or commercial use of the content is strictly prohibited.
4. LAB Post-Production Services
4.1 Photo Retouching:
Photo retouching is offered in packs of 10, 25, or 50 photos, or on an individual basis. All photos are delivered in JPEG format, sized according to the original files provided by the client.
4.2 Video Post-Production:
Video services include editing, color grading, motion design, and music. Films are delivered in MP4 format with durations of 1 minute, 3 minutes, or 5 minutes. Color grading for video sequences is available in packs of 10, 20, or 30 sequences, or individually if each sequence does not exceed 59 seconds.
4.3 Delivery Times:
Delivery times depend on the current queue and will be communicated before placing an order.
4.4 Rights and Ownership:
Clients retain full rights to their images and videos. Blue-lens.com acts solely as a service provider and does not claim ownership of the media provided.
4.5 Payment:
Full payment is required in advance for all post-production services. No revisions are included. Clients are encouraged to provide the best possible RAW materials for the best results.
5. Payment and Cancellation
5.1 Workshop Payments:
A deposit is required at the time of booking to confirm your workshop participation. The balance is due 60 days before the workshop start date. If full payment is not received by the due date, Blue-lens.com reserves the right to cancel your booking.
5.2 Cancellation by Participant:
- Non-Refundable Deposits: The deposit is non-refundable as it covers initial workshop organization costs.
- Cancellation More Than 60 Days Before the Workshop: Full refund of the workshop fee, minus any non-refundable deposit or fees.
- Cancellation Within 60 Days of the Workshop Start Date: No refunds unless Blue-lens.com fills your spot. If filled, a refund may be issued minus a processing fee.
- No Shows: If you fail to attend without prior notice, no refund will be issued.
5.3 Workshop Changes or Cancellations by Us:
If we need to cancel or reschedule the workshop due to unforeseen circumstances, we will offer you a full refund or a credit for future workshops, depending on your preference.
5.4 Cancellation Due to Insufficient Participants:
If the minimum number of participants is not reached, Blue-lens.com will notify clients at least 45 days before the start date. Participants may receive a full refund or transfer their booking to a future workshop, based on availability.
5.5 Payment and Cancellation for Online Tutorials:
Full payment is required for online tutorials. Once payment is received and access is granted, no refunds are issued. Since tutorials are digital, no cancellations or refunds are possible after access is granted. If technical issues prevent access, please contact Blue-lens.com for assistance.
5.6 Payment for Post-Production Services:
All post-production services require full payment in advance. Once full payment is made, no refunds are issued for these services.
6. Liability
6.1 Workshop Liability:
Blue-lens.com is not responsible for injuries, accidents, or damages during the workshop or diving activities. Participants are responsible for their own safety and must have their own diving insurance and a medical certificate of fitness.
6.2 Unforeseen Circumstances:
Blue-lens.com is not responsible for damages, cancellations, or modifications due to unforeseen circumstances such as weather conditions, government restrictions, or other factors beyond our control.
6.3 Tutorial Liability:
Blue-lens.com provides tutorials for educational purposes and does not guarantee specific outcomes. Clients must ensure their equipment and software are compatible. Blue-lens.com is not liable for technical issues, errors, or damages resulting from tutorial use.
6.4 Post-Production Liability:
Blue-lens.com is authorized to modify original works (e.g., retouching, cropping, color adjustments) as part of the service. The client retains full rights to their images and videos. Blue-lens.com uses these rights solely to provide the services requested and does not engage in resale or commercial exploitation without the client’s consent.
Blue-lens.com is not liable for legal claims arising from modifications made to the client’s media or from the presence of copyrighted or trademarked elements in the provided materials.
7. Privacy and Data Protection
7.1 Privacy Policy:
We process personal data in accordance with applicable data protection laws, including the GDPR. Please refer to our Privacy Policy for more details.
8. Governing Law and Disputes
8.1 Governing Law:
These Terms are governed by the laws of Andorra.
8.2 Disputes:
Any disputes arising under these Terms shall be resolved first through mediation. If mediation fails, the dispute will be submitted to the competent courts in Andorra.
9. Miscellaneous
9.1 Changes to Terms:
Blue-lens.com reserves the right to modify these Terms at any time. Changes will be posted on the Website and take effect immediately.
9.2 Force Majeure:
Blue-lens.com is not liable for any failure or delay in performance due to circumstances beyond its control, including acts of God, strikes, or natural disasters.
